REGULATION on the financial claims and liabilities

RECTOR’S REGULATION NO. 25 of 20 March 2020 on the rules of exemption from collecting some financial claims and liabilities from students, doctoral candidates and contractors of the SGH Warsaw School of Economics, suspension and rission thereof due to the state of epidemic threat of the coronavirus SARS-CoV-2       

Pursuant to Article 23 par. 1 and par. 2 point 10 in conjunction with Article 386 of the Act of 20 July 2018 – the Law on Higher Education and Science (Journal of Laws of 2020, items 85 and 374) in conjunction with Article 55, Article 56 par. 1 point 5 and Article 57 of the Act of 27 August 2009 on Public Finances (Journal of Laws of 2019, item 869, as amended), it is hereby regulated as follows:

§ 1

Due to the declaration of the state of epidemic threat or a possible state of emergency related to the spread of the coronavirus SARS-CoV-2 and thus caused difficult economic situation, as well as financial situation of natural and legal persons, acting in the public interest, the rules of exemption from collecting or suspension of collecting certain accounts receivable and remission of some liabilities are hereby stipulated.

§ 2 

1. Payment of instalments of fees for studies due for March and April 2020 is hereby suspended until the end of May 2020.

2. Due to the suspension of instalments of fees referred to in par. 1, interests due to delay are not calculated and interests calculated for the period between 12 March 2020 until the day of this regulation entering into force are hereby remitted.

3. Depending on the development of the epidemic situation, the suspension period referred to in par. 1 may be prolonged.

4. Upon the lapse of the period of suspension referred to in par. 1 the student can apply for breaking down the suspended payments into instalments.

§ 3 

1. Penalties for untimely return of books to the Library of the SGH Warsaw School of Economics for the period from 14 March 2020 until the end of the month following the month of resuming provision of services to readers at the Library are hereby remitted.

2. The outstanding books should be immediately returned upon resuming provision of services to readers at the Library.

§ 4 

1. Due to the suspension, by the decision of the Minister of Science and Higher Education of 11 March 2020, of the stationary classes in the premises of the University as of 12 March 2020, the student, who has left the student hostel of the SGH Warsaw School of Economics due to the suspension of classes, pays a fee for March 2020 in the amount of 40% of the monthly fee for accommodation.

2. As of April 2020, no fees for accommodation at student hostels of the SGH Warsaw School of Economics are collected for the period after leaving them by the student due to the suspension of classes referred to in par. 1, until the day of the re-accommodation, upon re-starting classes at the University’s headquarters.

3. Provisions of par. 1 and 2 apply in the case of notifying the administration of student hostels about leaving the student hostel due to the circumstances referred to in clause 1.

4. Upon a justified request of the student continuing to use the accommodation at the student hostel, the fee for accommodation may be suspended until the end of the period of the state of epidemic threat or the state of emergency.

5. No interests due to delay are charged for the period referred to in par. 4.

6. Upon the end of the state of epidemic threat or the state of emergency, the student referred to in par. 4 may apply for breaking down the suspended fees for accommodation into instalments.

7. Payments for incomplete months are settled proportionally, with a reservation of par. 1.

§ 5

1. In the period of the state of epidemic threat or the emergency state, contractors of the SGH Warsaw School of Economics may apply for suspension of payments or breaking down the amounts due to the University into instalments or for remission of interests due to delay or contractual penalties in case of an extraordinary change of the conditions and if it is justified with the public interest or, in cases justified with social or economic considerations, in particular, the debtor’s payment capacity.

2. Decisions in cases referred to in par. 1 are taken by the Chancellor of the SGH Warsaw School of Economics.

§ 6

Provisions of the regulation regarding students of the SGH Warsaw School of Economics apply to doctoral candidates of the SGH Warsaw School of Economics, respectively.

§ 7​

The regulation enters into force on the day of signing.
